- The following terms are defined as:
- "Charity Lottery Bet"; means each ticket is a fixed odds bet based upon the temperature in degrees Celsius recorded at 11 AM on the day of the event in the designated weather station of each city of Adelaide, Hobart, Darwin, Perth, Sydney, Brisbane and Melbourne.
- "Charity Lottery Subscription" means the entitlement of a particular Client to place a Charity Lottery Bet.
- "Charity Lottery Bet Close" is 11pm (Sydney time) - the day before the event. This is the time that Charity Lottery ceases accepting new bets or cancelations of bets in a particular event prior to commencement of that event.
- A Client may play Charity Lottery by visiting www.charitylottery.com.au.
- A Client may only have 1 Charity Lottery account.
- By electing to participate in Charity Lottery, a Client is granting Charity Lottery permission to debit that Client's account each four week period according to the terms of their subscription agreement.
- Charity Lottery enables the Client to elect to automatically participate in a specific Bet for a specific period of time. (known as the subscription service).
- The minimum period for a Charity Lottery Subscription is 4 weeks. A Client is free to cancel his or her Charity Lottery Subscription at any time. Upon cancelling the Charity Lottery subscription, any outstanding bets in the Clients account shall stand.
- In order to place a Charity Lottery Bet, a Client selects 7 values, between 0-9. Each number represents the first number to the immediate right of the decimal point for the temperature in degrees Celsius recorded at 11am on the day of the event at the designated weather station of each city in the Charity Lottery City List.

- Charity Lottery reserves the right to change the Charity Lottery City List for new events in its sole discretion. If the Charity Lottery City List is amended, notice will be posted on the Charity Lottery website.
- It is a Client's responsibility to check the Charity Lottery website regularly and familiarise himself or herself with the City List to which his or her Charity Lottery Bets for the following weeks relate.
- A Client may only bet on a unique 7-number combination. In other words, 2 Clients may not have a Charity Lottery Bet in respect of the same 7 numbers in the same order. This unique entry requirement means that in some instances a Client may not be able to select his or her first choice of 7 numbers.
- If a Client wishes to pick a 7-number combination already selected by another Client, Charity Lottery will endeavour to advise the Client of the inability to proceed with the selection and Charity Lottery will not accept the selection for that combination.
- In the event that a system fault occurs and the same numbers are selected by more than one Client in a single Charity Lottery event resulting in a tie for the same place (payout) on 7/7, all applicable tickets will be paid at face value of the ticket divided by the number of Clients tying for that placing (payout).
- A 7-number combination is secured by a Client for the period that:
- the numbers are stored by the Client in the Client's account; and
- the Client's Charity Lottery Subscription status is Pending, Active.
- A Client's 7-number combination will be released and available for other Clients to bet on upon the following instances:
- the Client changes his or her numbers to a new combination; or
- the Client's Charity Lottery Subscription is removed and no further outstanding bets exist in their account with that combination.
- If the Client selects the correct value for 2 or more cities, the Client wins a payout subject to the following payout table:

- If a Client's 7-number combination is capable of being correct in more than one way, the Client will win a payout in respect of which result results in the most number of correct cities only. For example, if the Client picks the numbers 1-2-3-4-5-6-7 and the numbers 1, 1-2 and 1-2-3 are correct for 1, 2 and 3 cities respectively, the payout will only be awarded in respect of 3 cities.
- Charity Lottery reserves the right to change the Charity Lottery payout table in clause 62 in its sole discretion for new events. If the payout table is amended, notice will be posted on the Charity Lottery website.
- Each week, Charity Lottery will select 2 alternative weather stations for every designated weather station. If:
- designated weather station in the Charity Lottery City List does not report any temperature for a particular day of the event at 11 AM in that city, Charity Lottery will use the temperature reported at 11 AM in that city at the first alternative weather station.
- the first alternative weather station does not report any temperature for a particular day of the event at 11 AM in that city, Charity Lottery will use the temperature reported at 11 AM in that city at the second alternative weather station.
- the second alternative weather station does not report any temperature for a particular day of the event at 11 AM in that city, Charity Lottery will reschedule the event to another day before the next week's event, in which case the temperatures will be determined with reference to the temperatures recorded at the designated weather stations for that day (using the procedure in this clause 65a to determine the temperature in a situation where a designated weather station does not report).
- if for any reason there is a variance between the official observations and the offical website, the temperatures published on the offical website at the time of the draw will be deemed to be the correct numbers for the purposes of a Charity Lottery event.
Bet Activity
- Charity Lottery does not operate a lottery, nor does it sell or resell lottery tickets - the Bets are sports bets. Charity Lottery is licensed by the Northern Territory Racing Commission as a sports bookmaker.
- All Bets are considered to be placed and received in the Northern Territory.
- Charity Lottery reserves the right to decline, or limit, any Bet a Client attempts to place. No Bet stands until Charity Lottery has issued a Ticket Reference Number within the client's account.
- No Bet may be cancelled by a Client.
- A Bet is deemed void (even if accepted) if it's submitted after the official closing time of an event.
- Bets can only be made via the Website and will not be accepted via any other means - this includes email, phone, fax and post.
- Bets may only be placed using cleared funds making up the "Available Balance" within a Client's account. Deposits via methods such as credit cards and bank transfers do not constitute cleared funds until such time as Charity Lottery has received notification by its relevant bank/payment facility of acceptance of the funds and Charity Lottery has approved the funds for use within the Clients account. Charity Lottery do not charge credit card fees however some credit card deposits may be subjected to a 'cash advance' fee as enforced by individual banks. Please check with your bank to see if your deposit will be treated as a 'cash advance'.
- Charity Lottery does not offer users credit for betting.
Results
- The offical observations website is the authoritative source of results for Charity Lottery events. Primary, secondary and tertiary stations used can be found at www.charitylottery.com.au/page/stations
- If at any time the offical result updates or changes observations on its website after the settlement of a Bet, the results published by Charity Lottery shall remain in effect as the official result.
- Should a Client be proven to, or be associated with someone who has undertaken to, alter the results published by the official website or the results collection process through fraudulent methods, Charity Lottery retains the right to recoup all winnings plus interest from Client.
- Charity Lottery gathers all results as soon as possible after each event. Winnings are then credited to a Client's account as soon as practicable. The availability to withdraw amounts or use these amounts to place a Bet are usually:
- Less than $25,000: Immediately
- $25,001 and above: After a period determined by Plus Connect (NT) of up to 21 days
Customer Identification Requirements
- To comply with Charity Lottery's obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we require all newly registered Clients to provide us with adequate identification for the purposes of conducting identity verification.
- A person seeking to become a Client is required to provide that her/his name, address and date of birth upon registration.
- Charity Lottery provides Clients two methods to verify identity:
a. (electronic) a link to a third party electronic identity checking service will be provided during the registration process and the person registering should complete the necessary steps;
b. (paper based) or Email 2 current documents to verification@charitylottery.com.au, we require 2 legal documents. One must confirm your name and D.O.B and one must confirm your name and address.
- If a person's identity has not been verified within 45 days of opening his or her account, that account will be suspended and any balance in the account frozen.
- Under the terms of the Plus Connect (NT) Licence and notwithstanding any other term of these Conditions, if a Client's Account is suspended, all Bets placed up to that point will stand.

- Charity Lottery is not permitted to allow the withdrawal of any amount from a Client's account until the identity of the Client has been verified. Any amount will be released as soon as this process has been completed.
Bonuses
- If a Client is granted a bonus from Charity Lottery, the Client is not permitted to withdraw these funds until the total bonus amount is wagered 1x its value on one or more Bets.
- Charity Lottery reserves the right to cancel and/or not award a bonus to a Client if it becomes apparent that an individual alone or together in concert is attempting to take undue advantage or manipulate the spirit of the bonus. The decision of whether an action is an attempt to take undue advantage or manipulate the spirit of the bonus is at the sole discretion of Charity Lottery.
- Charity Lottery reserves the right to make changes to or end a bonus without notice. Any decision to change a bonus will not affect those Clients that have already received the bonus.
- Charity Lottery reserves the right, in its absolute discretion, to refuse to allow a Client to participate in Bonus Promotions. Charity Lottery will provide written notification to any such Client whom Charity Lottery determines will not be eligible to participate in Bonus Promotions from notification.
- Bonus Promotions may include specific terms and conditions related to when a Bonus can be used, i.e. restricted to use on specific events, or with a specific expiry date and Clients should read the restrictions, if any, disclosed in any additional terms and conditions.
Self Exclusion
- A Client may exclude themselves from further betting by contacting the Charity Lottery support department via our contact form on site or directly via email at support@charitylottery.com.au. Alternatively, the Client can reach us at 1300 780 782 during office hours, but we must receive your request in writing to validate your information.
- A Client may request a cool off period during which he will be excluded from using his or her account and/or creating an account. The cool off period must be no less than 30 days and the Client may request this period to be extended or renewed. Unless specified otherwise, the Charity Lottery will exclude the person indefinitely.
- A person considering exclusion, or having requested exclusion, is also encouraged to read our Responsible Gambling policy which can be found at charitylottery.com.au/responsible-gambling.
- A person may request reversal of his or her exclusion by emailing our support department. The reversal will be subject to the requirements at Northern Territory law and the licence granted to Charity Lottery. Subsequent to completing those requirements, the person will be advised of any remaining steps to complete the removal of exclusion. Charity Lottery reserves the right to refuse to revoke any exclusion.
- In respect of a person that excludes themselves:
- all Bets on events that have yet to occur will be still stand,
- any subscription (such as the Charity Lottery Subscription) will be cancelled subject to the terms of this Agreement.
Marketing
- Charity Lottery handles data and tracks activity of Clients and visitors to the Website in accordance with our Privacy Policy at www.charitylottery.com.au/page/privacy-policy.
- A Client is elected by default to receive promotional email related to Charity Lottery, its products and other products supplied by third parties. To be excluded a client can contact Charity Lottery asking to be excluded in writing at support@charitylottery.com.au
Miscellaneous
- A Client's use of Charity Lottery may be subject to the consumer guarantees of the Competition and Consumer Act 2010 (Cth). Nothing in this Agreement is intended to exclude, restrict or modify these guarantees or any remedies which you may have in respect of these guarantees. To the extent permitted, we restrict our obligations under these guarantees to the minimum and any damages to the minimum amount.
- Charity Lottery has made considerable efforts to ensure its business operates in a fair, prompt and accurate manner. Save to the extent permitted by law (and only to such an extent), Charity Lottery excludes all warranties (express or implied) relating to its business and shall not have any liability for direct, indirect, special, incidental, consequential or exemplary loss, damage, expense or injury suffered by any Client.
- To the extent permitted by law (and only to such an extent), Charity Lottery's liability in respect of any claim or loss shall be limited in amount to the stake of the Bet placed.
- To the extent permitted by law (and only to such an extent), Charity Lottery accepts no liability for any damages or losses arising from, or caused by, the Website or site's content, including any person's inability to access the site or any delays in transmission.
- Where a Client has been referred to Charity Lottery by a third party including by a third party operated website and where that third party is an affiliate or agent of Charity Lottery, Clients acknowledge that Charity Lottery may make commission payments to that third party. Payments to agents or affiliates are unrelated to the odds or prize money offered to Clients by Charity Lottery.
- This Agreement represents the entire understanding and agreement between the Client and us on this subject matter and supersedes all other previous agreements.
- Charity Lottery shall not be liable for any loss or damage that may arise from any aspect of the Web Site or its availability or functionality not within the control of Charity Lottery.
- All transactions are processed in Australian Dollars (AUD). Any withdrawals that are requested in another currency than AUD will incur all currency conversion fees.
